Protocol for medico-legal cases
Brought in Emergency
 
1.       For Dead Bodies
2.       For Living cases
 
For Dead Bodies:-
 
                All the cases brought dead/ declared dead on arrival.
1.       Police Station Banur should be informed.
2.       Police information should be sent on the Proforma of the hospital in duplicate (Annexure A)
3.       This will be sent along with Medico-legal Dak Book (Register No. 2) after making entries in the dak book to Police station.
4.       Dead body should be taken into custody and kept in the dead body room.
5.       Entry in the register (Dead body custody register no 4) should be made.
6.       List of valuables should be made and kept in safe custody.
7.       A tag should be tied round the wrist and number and details should be entered on it.
8.       It is the responsibility of EMO to keep the safe custody of body and valuables.
9.       Charges of the dead bodies and valuables should be handed over to the Next EMO taking Charge.
10.   The dead body should be handed over to police for postmortem examination along with valuables after taking proper receipt in dead body custody register.
For Living Cases
 
1.       All cases of attempted Homicide/suicide/accident/assault including cases of poisoning/ burns/ occupational hazards and sexual assault should be informed to the Police.
2.       All cases which are referred to Gian Sagar Medical college & Hospital and which are cases of attempted Homicide/suicide/accident/assault including cases of poisoning/ burns/ occupational and sexual assault should be informed to the Police irrespective of the matter whether they have been previously been informed or not.
3.       If a case has been brought by the police official, name, designation /number of the police official if any and name of police station along with number of DDR if any should be recorded by the EMO.
4.       If a case has been sent by court orders name of the judge and name of the court from where it has been ordered should also be recorded along with other details by the EMO.
5.       All such above mentioned cases should be entered into the emergency medico legal OPD (Register No. 1) register by the Emergency Medical Officer. And all the columns in the register should be filled and EMO should sign it writing clearly his name in block letters. [Date and time of arrival in the hospital should be entered with a valid serial Emergency number, Name of patient father/husband name, address age sex, brought by whom,. Alleged place of occurrence along with police station if known should be recorded. Dispatch number as in the Dak book should also be entered].
6.       Emergency Medical Officer will do the life saving and other necessary treatment.
7.       Police information should be sent by the Emergency Medical Officer.
8.       Police information should be sent on the Performa of the hospital in duplicate (Annexure A)
9.       This will be sent along with Medicolegal Dak Book (Register No. 2) after making entries in the dak book to Police station. Signature of concerned police official should be taken on the dak book along with his name/number and police station.
10.   Conscious Patients should be asked whether he want any medico legal examination/Report or not. In case of Unconscious/ serious patients, accompanying relatives should be asked, whether they want any medico legal examination/Report or not. Same can be confirmed by the treating doctor when the patient becomes conscious. In case of any discrepancy call should be sent by treating doctor to the doctor on medico legal examination duty.
11.   If there is consent for medico legal examination then call should be sent in writing/telephone to the concerned doctor on the duty roster for medico legal examination. In case of sexual assault if the victim/assailant is female call should be sent to the female duty doctor of obstetrics & gynecology department.
12.   Concerned Doctor on medico legal examination duty will come immediately and do the medico legal examination on (Register No.5). Female duty doctor of obstetrics & gynecology department will do the examination as per Proforma sent by the head of obstetrics & gynecology department (Annexure-G). Report will be prepared by the concerned doctor immediately after doing the examination.
13.   Gastric lavage/induced vomiting if done should be preserved by the doctor who is doing the gastric lavage/induced vomiting. It should be preserved and sealed by the concerned doctor. Gastric lavage/induced vomiting along with other relevant samples should be handed over to concerned police official by the concerned doctor.
14.   In case patient/ relative/ attendant do not want any medico legal action against the case. The same should be put in writing in the Medicolegal OPD register (No 1). Same should be mentioned on the Hospital File also.
15.   Hospital file should be stamped on the title page about the status of the case by the EMO.
a.       Police informed
b.      Medicolegal Examination Done
c.       Medicolegal examination refused/ deferred.
16.   Duplicate copy of the police information Performa should be kept in safe custody in file (NO. 3) by EMO till handing over of the report to MRD/CR office.
17.   Copy of the Police information report duly signed by concerned police official should be send to MRD/CR office under proper receipt in Medico legal dak book.
18.   It will be duty of the EMO to keep the safe custody of registers and hospital file of such cases.
19.   Medicolegal examination should be done as early as possible making four copies
a.       Original copy should be sent to Police station after entering into the medico legal dak book through Hospital employee mentioning his name in the medico legal dak book.
b.      One copy to be pasted in Hospital file.
c.       One copy to patient under proper receipt.
d.      One self copy.
20.   If medicolegal radiological examination is required, then concerned doctor will issue medico legal radiological examination form (Annexure B) in duplicate (Under proper receipt) immediately after completing the medico legal examination?
21.   If any other investigation is requested forms for the same (Annexure C) in duplicate should be issued (Under proper receipt) immediately.
22.   It will be the duty of the doctor doing the medico legal examination to keep the safe custody of the medico legal registers.
23.   When the patient is shifted from emergency IPD to the concerned ward, police informed/medico legal examination file should be handed over to concerned ward under proper receipt after entering into the medico legal dak book.
24.   All the findings and treatments/calls in medico legal/Police informed cases should be entered in emergency Medicolegal OPD/OPD register /case file by the Emergency Medical Officer.
25.   All the specialists attending the call will put their observations/treatment in the emergency Medicolegal OPD/OPD register /case file
26.   If the case is referred to some other institute then on the referral slip it should be clearly mentioned that this is a police informed/medico legal examination done/medico legal examination refused/medico legal examination deferred citing the proper reason of deferral of examination of the case
27.   Surgeon/ Specialist will keep Police informed/ Medicolegal Case File in safe custody. Copy of the medico legal examination report should be read carefully particularly taking note of the injuries/condition kept under observation. All the entries of investigations/results of investigation, procedures/ treatment should be entered promptly. File should be completed immediately at the time of discharge/death of the patient. In case of any difficulty encountered in medico legal aspect, forensic medicine doctor on duty in the emergency may be consulted.
a.       In case of discharge: - Police informed/ Medicolegal Case file should be sent immediately to the CR/MRD under proper receipt. If any injury has been kept under observation relevant information should be sent to the concerned doctor who has done the medico legal examination so that nature of injuries/Kind of weapon can be declared (Under proper receipt). Police should be informed at the time of discharge of such patients.
b.      In case of death: - Police informed/ Medicolegal Case file should be sent immediately to the CR/MRD under proper receipt and photocopy of file should be given to the concerned Police official along with the dead body (Under proper receipt).
28.   In case any investigation has been requested the concerned official doing the investigation will send the report to the concerned doctor who has done the medico legal examination so that nature of injuries/Kind of weapon can be declared (Under proper receipt). This report should be on the back of Medicolegal investigation requisition form/Slips/Report in any other form which should mention the identification marks mentioned in the of Medicolegal investigation requisition form/Slips. Name of the department and concerned doctor issuing the report should be clearly readable (preferably BLOCK Letters).
29.   The doctor doing the medico legal examination will send the received reports/ Medicolegal X-ray immediately to the concerned police station (Under proper receipt).
30.    On the basis of this report if nature of injuries / kind of weapon/duration of injuries which were kept under observation, should be declared by doctor who has done the medico legal examination and should be sent to concerned police official immediately (Under proper receipt).

Objectives
 
                The departmental objectives in the department of Forensic Medicine & Toxicology are as follows:
 
1.Teaching under Graduate students of Gian Sagar Medical College.
 
a.     Teaching undergraduate students for 100 hours as per MCI Instructions (Annexure A)
                                                              i.      21 6 hours of teaching already done(18/11/2008)
b. Cover the syllabus as per Baba Farid University of health Sciences 12 units (Annexure B)
                                                            i.      Death and general toxicology covered 2 units
c.   To evaluate the students by having 10 Internal class tests-
                                                           i.      One class test already held on 18-11-2008.
 
2.Research Work concerned with Forensic Medicine department.
a.     Five projects was to be completed in this academic year-2007-08
                                                              i.      Two projects completed
1.     Bite marks on various objects: Comparison and analysis
2.     Medicolegal awareness in the doctors in medical colleges
                                                        ii.      Three projects at present to be covered in remaining period of this academic year.
1.121 cases already done in “Fetal age determination from length of femur and humerus by Ultrasonography”.
2.     10 cases already done in “Impact of white ribbon campaign in India
3.     5 cases already done in “Determination of Age Abrasions by Naked Eye Appearances”
